These terms apply to purchases made through oneofothers.com and to your use of the website.
The website is operated, and products are supplied, by ONE OF OTHERS PTY LTD, ABN 67 685 512 814. Our business address is 14 Toorak Road, South Yarra VIC 3141, Australia. You can contact us at hello@oneofothers.com.
By placing an order, you agree to these terms and the policies presented to you at checkout. The version in effect when you place your order will apply to that purchase.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, statutory remedy or other right that cannot lawfully be excluded, restricted or modified.
By submitting an order, you offer to purchase the selected products at the price shown at checkout.
The product description, price, delivery option and other information shown at checkout form part of your order.
Payment is required when you submit your order. You confirm that you are authorised to use the payment method selected at checkout.
We will email you when we receive your order. This email acknowledges receipt and does not mean that we have accepted the order. A contract is formed when we send confirmation that the order has been accepted and dispatched.
Before accepting an order, we may decline it because a product is unavailable, payment cannot be authorised, we reasonably suspect fraud, we cannot deliver to the selected address, or there is an obvious product or pricing error. If we decline an order after taking payment, we will promptly return the payment to its original payment method.
Australian orders are generally charged in Australian dollars (AUD), New Zealand orders in New Zealand dollars (NZD), and international orders in United States dollars (USD). The currency and total amount payable will be shown before you authorise payment. Your payment provider may apply currency conversion or other charges under its own terms.
The total payable amount, including applicable taxes, delivery charges and other unavoidable charges, will be shown before you place your order.
Prices may change for future orders. A price change will not affect an order we have already accepted.
Our Shipping and Delivery information explains our delivery options, charges and estimated timeframes. The options available for your order will be shown at checkout.
We will deliver your order within the timeframe agreed with you or otherwise within the period required by applicable law.
We remain responsible for loss of or damage to the goods until you, or a person you nominate other than the carrier, receives them. This does not apply if you independently arrange delivery through a carrier we did not offer.
For orders delivered outside Australia, import duties, taxes or clearance fees may apply. Unless checkout states that these charges are included, you are responsible for paying them. We will tell you before ordering if additional charges that we cannot reasonably calculate may be payable.
Please check your delivery information before submitting your order. If you need to make a change, contact us as soon as possible. We may not be able to change an order once it has been processed.
Our Returns Policy explains our voluntary change-of-mind return conditions and how to request a return.
Those conditions do not limit any rights that cannot lawfully be excluded, including rights relating to faulty, damaged, misdescribed or otherwise non-conforming goods.
If EU consumer law applies to your online purchase, you have a statutory right to withdraw from all or part of the purchase without giving a reason. The Returns Policy explains the withdrawal period, how to notify us, return costs, reimbursement and the model withdrawal form. You may also use our Withdraw from contract here function.
If an item is faulty, damaged, misdescribed or otherwise does not conform to your order, please contact hello@oneofothers.com. Photos may help us conduct an initial review, although we may also need to inspect the item.
For Australian consumers, our goods come with consumer guarantees that cannot be excluded under Australian Consumer Law. If a product has a major failure, you may choose a refund or replacement and may also be entitled to compensation for other reasonably foreseeable loss. We will remedy other failures within a reasonable time as required by law.
Where EU consumer law applies, goods have a minimum two-year legal guarantee of conformity from delivery. Some countries provide longer protection.
We will not require you to accept store credit where applicable law gives you the right to a monetary refund or another remedy.
Ordinary wear and tear, misuse or failure to follow reasonable care instructions is not a product fault. This does not affect a claim where the goods fail to meet an applicable consumer guarantee or legal guarantee.
Store credit issued following a voluntary return is personal to the recipient and cannot be transferred to another account.
Store credit is issued as a gift card. Store credit is valid for at least three years from its issue date. Any applicable expiry date will be shown when the gift card is issued.
Store credit cannot be redeemed for cash or used instead of a refund or other remedy required by law.
If an order paid partly with store credit is cancelled or returned, the amount paid using store credit will be restored as store credit. Any remaining refundable amount will be returned to the original payment method, unless applicable law requires otherwise.
We may offer promotional or welcome codes from time to time. The eligibility requirements, validity period and other conditions will be shown with the offer.
Unless an offer states otherwise, only one promotional code may be used per order. You must enter and apply the code at checkout.
A promotional code cannot be applied after an order has been accepted unless we agree otherwise.
The product designs, photographs, imagery, text, graphics, logos and other website content are owned by or licensed to ONE OF OTHERS and are protected by applicable intellectual property laws.
You may use the website and its content for personal, non-commercial purposes. You must not reproduce, modify, distribute or commercially use its content without our written permission, except as permitted by law.
You must use the website lawfully. You must not interfere with its operation or security or attempt to gain unauthorised access to it.
We may restrict access where reasonably necessary to protect the website, our customers or our legal rights. Restricting website access does not affect an accepted order or any statutory rights relating to a purchase.
Our Privacy Policy explains how we and our service providers collect, use and disclose personal information.
These terms are governed by the laws of Victoria, Australia.
The courts of Victoria have non-exclusive jurisdiction, subject to any mandatory law that applies. Nothing in these terms deprives you of mandatory consumer protections or any right to bring proceedings in another court with jurisdiction over the dispute.
